Maraming tao ang may assumption na kapag nag-divorce sa England and Wales, automatic na 50/50 ang hatian ng bahay, savings, pension at iba pang matrimonial assets.
Hindi ganoon kasimple.
Sa financial settlement, ang objective ng court ay magkaroon ng fair outcome based sa actual circumstances ng mag-asawa. Under section 25 of the Matrimonial Causes Act 1973, tinitingnan ng court ang income at earning capacity ng bawat isa, financial needs, responsibilities, standard of living during the marriage, age, length of marriage, health or disability, contributions to the family at iba pang relevant circumstances. Importante rin ang welfare at housing needs ng mga anak.
Kaya posible na ang final division ay hindi eksaktong 50/50.
1. Mas malaki ang income at earning capacity mo kaysa sa ex mo
Kung malaki ang difference ng inyong income, hindi ibig sabihin na automatic na kukunin ng court ang higit sa kalahati ng assets mo.
Pero relevant ito.
Halimbawa, kung ikaw ay kumikita ng £70,000 per year habang ang ex-spouse mo ay kumikita lamang ng £20,000, maaaring tingnan ng court kung sino ang mas madaling makakabangon financially pagkatapos ng divorce.
The court considers not only present income, but also earning capacity and financial resources that each party has or is reasonably likely to have in the foreseeable future.
So kung mas malakas ang financial position mo at mas mahina ang sa ex mo, puwedeng makaapekto iyon sa overall settlement—particularly where there is not enough money to meet both parties’ needs comfortably.
2. Sa ex mo pangunahing titira ang mga anak
Ito ang isa sa pinakamahalagang considerations.
Kung ang mga anak ay pangunahing titira sa ex-spouse mo, kailangan niyang magkaroon ng suitable accommodation para sa mga bata.
For example, baka kailangan niya ng three-bedroom property samantalang ikaw ay maaaring mangailangan lamang ng smaller accommodation.
Kapag limited ang matrimonial assets, maaaring kailanganing bigyan ng mas malaking bahagi ng available capital ang parent na pangunahing nagha-house sa mga bata.
Official guidance confirms that where the court decides the finances, arrangements for children—particularly their housing—are considered first.
Hindi ito punishment sa kabilang parent. Ang focus ay practical needs ng pamilya pagkatapos ng separation.
3. May medical condition o disability ang ex-spouse mo
Health and disability can also affect the settlement.
Halimbawa, kung ang ex-spouse mo ay may serious medical condition na nakakaapekto sa kanyang ability to work, maaaring mas mababa ang kanyang future earning capacity.
Posible ring magkaroon siya ng additional expenses for care, transport, treatment, o specially adapted accommodation.
Ang physical or mental disability of either spouse ay expressly included among the matters the court may consider when deciding financial arrangements.
Again, hindi ibig sabihin na automatic silang makakakuha ng more than 50%. Pero maaaring maging significant factor ito kapag ina-assess ng court ang future needs ng bawat party.
4. Nag-sacrifice ang ex mo ng career para sa marriage o pamilya
Imagine na habang ikaw ay nagtatrabaho at nagpo-progress sa career, ang asawa mo naman ay huminto sa trabaho upang alagaan ang mga anak.
Pagkatapos ng 15 or 20 years, maaaring mataas na ang salary at pension mo habang ang spouse na nag-stay at home ay nahirapang bumalik sa parehong career level.
Hindi puwedeng simpleng sabihin:
“Hindi naman siya nagbayad ng mortgage, kaya maliit lang ang share niya.”
The court recognises contributions to the welfare of the family, including looking after the home and children—not only direct financial contributions.
However, a separate claim based purely on “career sacrifice” or compensation is relatively unusual. In most cases, the practical effect is considered through needs, resources, earning capacity and contributions rather than an automatic extra award.
5. Mas malaki ang financial needs ng ex mo
Ito ang maaaring pinakamahalagang point sa maraming ordinary family cases.
Kung may £500,000 worth of assets ang marriage, madaling isipin:
“£250,000 each.”
Pero paano kung ang isang spouse ay may malaking income, pension at sariling accommodation, habang ang isa naman ay mababa ang income, pangunahing nag-aalaga ng dalawang bata at kailangang bumili ng bahay?
Doon papasok ang concept of needs.
The court specifically considers each person’s financial needs, obligations and responsibilities. These can include the need for suitable housing and sufficient income to meet reasonable living expenses.
Kaya minsan, fairness does not necessarily mean mathematical equality.
Hindi Automatic ang 50/50 — At Hindi Rin Automatic ang More Than 50%
Ito ang mahalagang tandaan.
Walang simpleng formula na:
“Mas maliit sahod niya, therefore 60/40.”
O:
“Nasa kanya ang mga anak, therefore 70/30.”
Financial remedy cases are highly fact-sensitive.
Tinitingnan ng court ang buong financial picture: property, mortgage, savings, debts, pensions, income, future earning capacity, children’s needs, health, age, length of marriage at future housing requirements.
If the parties cannot agree, the court has power to determine how property, pensions, savings and other financial assets should be dealt with through a financial order.
Isang Importanteng Warning: Divorce Alone Does Not Automatically End Financial Claims
Isa rin itong common misunderstanding.
Ang pagkakaroon ng Final Order sa divorce ay hindi necessarily nangangahulugan na tapos na rin ang financial claims between former spouses.
Kung nagkaroon kayo ng agreement tungkol sa bahay, pension, savings or maintenance, it is normally important to consider having the financial agreement properly recorded in a court-approved financial order or consent order.
GOV.UK confirms that where spouses agree how to divide their finances, they can apply for a consent order to make that agreement legally binding.
Final Thought
Sa divorce, huwag agad mag-assume na:
“Half sa akin, half sa kanya.”
At huwag din agad maniwala kapag may nagsabi:
“Mas malaki contribution ko sa bahay, kaya mas malaki dapat ang makuha ko.”
Family finances are more complicated than that.
Ang tunay na tanong ay:
What would be a fair financial outcome for both parties and the children, taking into account all the circumstances of this particular marriage?
That is why proper legal advice before agreeing to sell a property, transfer a house, divide a pension or accept a settlement can make a very significant difference.
