Maraming tao ang hindi nakakaalam na under UK insolvency law, may mga circumstances kung saan ang malaking bahagi — at minsan halos lahat — ng qualifying unsecured debts ay maaaring legally written off.

🇬🇧 1. DEBT RELIEF ORDER (DRO)

✅ Total qualifying debts mo ay below £50,000
✅ Less than £75/month ang natitira after normal household expenses
✅ Assets mo are generally below £2,000

✅ You meet the England and Wales residence/work requirements
Kapag approved ang DRO, generally hindi ka muna magbabayad ng listed qualifying debts for 12 months.
Pagkatapos ng DRO period, subject to the rules, those qualifying debts can be legally discharged.
At presently, walang application fee for a DRO. Application must go through an approved debt adviser.
💷 2. INDIVIDUAL VOLUNTARY ARRANGEMENT — IVA
Kung mayroon kang regular income pero hindi mo talaga kayang bayaran lahat ng utang, maaaring magkaroon ng legally binding arrangement with creditors.
For example:
May utang kang £40,000.
Instead of trying to repay the entire £40,000, an IVA might provide for affordable payments over an agreed period.
Kapag successfully completed ang IVA, the remaining balance of debts covered by the arrangement may be written off.
BUT remember: may fees ang IVA, may restrictions, at hindi ito suitable sa lahat.
⚖️ 3. BANKRUPTCY
Bankruptcy is another statutory debt-relief procedure.
Normally, after around 12 months, you are discharged from bankruptcy and released from most bankruptcy debts.
Pero malaking decision ito.
Your:
• house/equity
• valuable assets
• savings
• surplus income
may potentially be used to pay creditors.
Bankruptcy currently costs £680 to apply for in England and Wales.
🚨 HINDI LAHAT NG UTANG NAWAWALA
Examples of debts that may survive particular insolvency procedures include:
❌ certain student loans
❌ criminal court fines
❌ certain child maintenance/family liabilities
❌ debts arising from fraud
❌ some personal injury liabilities
❌ some secured debts
So huwag isipin na:
“Mag-bankrupt lang ako, wala na lahat.”
Hindi ganoon kasimple.
🚪 MAY BAILIFF NA SA PINTUAN?
Do not panic and do not automatically assume na kailangan mong bayaran agad ang buong amount.
Depending on the debt and your circumstances, a formal insolvency procedure may restrict creditors from continuing enforcement.
Pero hindi lahat ng bailiff debts are covered, so kailangan munang malaman:
Ano ang utang?
Sino ang creditor?
May County Court Judgment ba?
Council tax ba?
Court fine?
Credit card?
Loan?
Utility debt?
At magkano lahat ng debts and assets mo?
⚠️ VERY IMPORTANT
Do not hide your money.
Do not secretly transfer your house or assets to relatives.
Do not pretend na wala kang assets.
Do not borrow money knowing na wala kang intention to repay it.
Insolvency law can provide genuine protection and a fresh start — but you must be completely honest about your financial circumstances.
Sometimes the answer is not “How can I pay all of this?”
The better question may be:
“Is there a lawful insolvency solution that could reduce or discharge these debts?”
Before entering any IVA, DRO or bankruptcy, get proper independent debt advice and compare all available options.

The current DRO limits are £50,000 total debt, generally under £75 monthly surplus income, under £2,000 assets and a vehicle below £4,000, and a DRO application is currently free.
