Maraming immigration problems ang nagsisimula hindi dahil walang chance ang applicant, kundi dahil mali ang advice, kulang ang information, o umasa sa sabi-sabi.
Sa UK immigration, isang maliit na misunderstanding tungkol sa visa requirements, absences, dependants o refusal ay maaaring magkaroon ng malaking epekto sa application.
Narito ang ilan sa mga common UK immigration myths na madalas nating marinig — at ang katotohanan sa likod ng mga ito.
MYTH #1: “Kahit wala akong job offer, pwede akong kumuha ng Skilled Worker visa.” ❌
FACT: Hindi ganoon kasimple. ✅
Para sa Skilled Worker route, generally kailangan mo ng qualifying job offer mula sa UK employer na may valid sponsor licence, at dapat ma-meet din ang applicable requirements tungkol sa occupation, salary, sponsorship at iba pang conditions.
Hindi sapat na sabihin lamang na:
“May experience naman ako.”
“Qualified naman ako.”
“May employer akong kakilala sa UK.”
Ang employer mismo must normally be authorised to sponsor migrant workers, at kailangan ng proper sponsorship process.
Lesson: Bago magbayad o umasa sa isang job offer, check muna kung legitimate ang employer at kung maaari ka talaga nilang i-sponsor.
MYTH #2: “Kapag nagpakasal ako sa British citizen, automatic na pwede na akong manatili sa UK.” ❌
FACT: Marriage alone does not automatically give you immigration status. ✅
Ang pagpapakasal sa British citizen o settled person ay hindi automatic visa at hindi rin automatic ILR.
Depending on the circumstances, kailangan pa ring ma-meet ang relevant requirements ng immigration route, which may include matters such as:
- genuine and subsisting relationship;
- appropriate immigration status or applicable exception;
- financial requirement;
- English language requirement;
- adequate accommodation; at
- suitability requirements.
Importante rin kung saan kayo nagpakasal, ano ang current immigration status mo, at anong route ang appropriate sa circumstances ninyo.
Marriage is evidence of a relationship — hindi ito automatic permission to remain.
MYTH #3: “Student visa ako, kaya pwede akong manatili sa UK indefinitely.” ❌
FACT: Ang Student visa ay temporary immigration permission. ✅
Ang purpose ng Student route ay primarily para mag-aral, hindi automatic route to permanent residence.
May restrictions din tungkol sa employment at duration of stay. Pagkatapos ng studies, maaaring may ibang immigration options depending on the person’s circumstances — for example, potentially switching into another qualifying route if the requirements are met.
Pero hindi ibig sabihin na dahil ilang taon ka nang nag-aaral sa UK ay automatic nang entitled ka sa ILR.
Always understand kung anong immigration route ang ginagamit mo at kung ang time spent on that route counts towards the settlement route you intend to rely upon.
MYTH #4: “Family ko naman sila, kaya pwede silang sumunod sa UK anytime.” ❌
FACT: Being your family member does not automatically make someone eligible for a UK visa. ✅
Different immigration categories have different rules para sa:
- spouses or partners;
- children;
- parents;
- adult dependent relatives; at
- dependants of work visa holders.
Halimbawa, maaaring qualifying dependant ang isang child sa isang particular route, pero may age, dependency, parental responsibility, relationship at timing requirements na kailangang tingnan.
Sa ibang cases, malaking issue rin kung ang isang parent ay nasa UK at ang anak ay naiwan sa Pilipinas — particularly where questions arise regarding sole responsibility, serious and compelling circumstances, or the child’s best interests.
Kaya hindi sapat na sabihin:
“Anak ko naman siya.”
The legal requirements and evidence still matter.
MYTH #5: “Pwede akong lumabas ng UK kahit gaano katagal. Basta may visa ako, okay ang ILR.” ❌
FACT: Absences can affect settlement eligibility. ✅
Isa ito sa pinakamahalagang bagay na dapat bantayan ng mga taong papunta sa Indefinite Leave to Remain (ILR).
Some settlement routes have specific continuous residence and absence requirements.
Hindi lamang tanong na:
“Valid ba ang visa ko?”
Kailangan ding tingnan:
Gaano katagal kang wala sa UK? Kailan ang trips? Ilang days ang absences mo within the relevant periods? May applicable exception ba?
Isang maling calculation ng travel history ay maaaring makaapekto sa timing ng ILR application.
Kaya bago mag-submit ng settlement application, magandang gumawa ng complete immigration and travel timeline.
MYTH #6: “Madali lang naman ang immigration application. Kaya ko itong DIY.” ❌
FACT: Some people can prepare their own applications — pero hindi lahat ng cases straightforward. ✅
May applications na relatively simple kapag clean ang immigration history at complete ang evidence.
Pero maraming cases ang nagiging complicated dahil sa:
- previous refusal;
- overstaying;
- criminal conviction or caution;
- previous deception allegation;
- relationship history;
- missing documents;
- complicated travel history;
- previous visa breaches;
- children living overseas;
- financial requirement issues; o
- inconsistencies sa previous applications.
Ang danger ng DIY application ay minsan hindi alam ng applicant kung ano ang problem until lumabas na ang refusal.
At kapag may refusal na, mas mahirap at kadalasan mas mahal na ang susunod na hakbang.
Hindi lahat ng application kailangan ng solicitor — pero dapat alam mo kung kailan kailangan ng professional assessment.
MYTH #7: “Kapag marami akong pera o nag-invest ako sa UK, guaranteed na ang visa ko.” ❌
FACT: Money alone does not guarantee immigration permission. ✅
UK visas are granted according to the requirements of the particular immigration route.
Kahit may substantial savings, property, business o investment ang isang applicant, hindi ibig sabihin na automatically qualified siya for a visa.
Kailangan pa ring malaman:
Anong immigration category ang ina-applyan mo? Ano ang eligibility criteria? At nasusunod mo ba ang requirements ng route na iyon?
Hindi puwedeng palitan ng pera ang legal eligibility requirements.
MYTH #8: “Na-refuse ang visa ko. Wala na akong magagawa.” ❌
FACT: A refusal does not always mean the end of the road. ✅
Ito ang isa sa pinakamalaking misconceptions.
Depending on the type of decision and circumstances, possible options may include:
- making a fresh application;
- submitting additional evidence;
- administrative review;
- appeal;
- further submissions;
- pre-action correspondence or judicial review in appropriate cases; or
- applying under a different immigration route.
Pero very important: huwag basta mag-submit ulit nang hindi inuunawa kung bakit na-refuse ang first application.
Basahin nang mabuti ang refusal letter.
Ano ba talaga ang finding ng Home Office?
Evidence issue ba? Eligibility issue? Credibility problem? Financial requirement? Relationship? Suitability? Deception allegation?
The correct strategy depends on the actual refusal reasons.
Huwag I-base ang Immigration Future Mo sa “Sabi Nila”
Maraming applicants ang nagsasabi sa consultation:
“Attorney, sabi ng kaibigan ko pwede raw.”
“May kakilala ako na ginawa ito at na-approve.”
“Sabi sa Facebook group okay lang daw.”
Pero tandaan: magkaiba ang immigration history ng bawat tao.
Kahit pareho kayong Skilled Worker, spouse, student or parent, maaaring completely different ang:
- visa history;
- date of entry;
- absences;
- family circumstances;
- salary;
- sponsorship;
- previous refusals; at
- evidence.
Ang naging successful para sa isang tao ay hindi automatic na tamang strategy para sa iyo.
Before you apply: Get the facts. Get the right advice. Get it right.
