Maraming couples ang nagtatanong sa akin: “Attorney, kailangan ba talaga na nagsama kami sa iisang bahay ng partner ko for 2 years bago ako makapag-apply ng Unmarried Partner Visa?”
Ang maikling sagot: hindi na mandatory na nakatira kayo together continuously for 2 years.
Pero may importanteng qualification diyan.
Hindi dahil hindi na mandatory ang 2-year cohabitation ay automatic nang qualified ang isang couple. Kailangan pa ring mapatunayan na ang relationship ninyo ay genuine, subsisting, durable, at similar to marriage or civil partnership.
Ano ang Unmarried Partner Visa?
Ang Unmarried Partner Visa ay isang route under the UK Family Visa rules para sa couples na hindi kasal o civil partners pero may committed relationship.
Under Appendix FM, ang focus ngayon ay kung kayo ay:
“in a relationship similar to marriage or civil partnership for at least 2 years.”
Ibig sabihin, ang importante ay hindi lamang kung ilang taon kayong nakatira sa isang address.
Ang mas malaking tanong ay:
Totoo ba ang relationship?
Committed ba kayo sa isa’t isa?
At maipapakita ba ninyo na ang relationship ninyo ay comparable sa isang married couple o civil partners?
Ano ang Nagbago?
Dati, bago 31 January 2024, ang wording ng Immigration Rules ay nangangailangan na ang unmarried partners ay:
“have been living together in a relationship similar to marriage or civil partnership for at least two years.”
Dahil dito, napakalaking issue dati kung hindi kayo nakapag-cohabit for 2 years.
Pero mula 31 January 2024, tinanggal ang strict requirement na kailangan kayong “living together” for the whole 2-year period.
Ang requirement ngayon ay ang existence ng qualifying relationship for at least 2 years.
Ito ang malaking pagbabago.
So Hindi Na Ba Important ang Cohabitation?
Important pa rin.
Ang cohabitation remains one of the strongest forms of evidence na ang isang relationship ay serious, committed at genuine.
Kung nakatira kayo together at mayroon kayong:
- joint tenancy;
- council tax;
- utility bills;
- bank statements;
- official correspondence;
- joint financial commitments; o
- ibang documents na parehong address,
mas madaling ipakita ang reality ng inyong relationship.
Pero hindi na ito ang only way para ma-prove ang relationship.
Paano Kung Hindi Kayo Nakatira Together?
Maraming genuine couples ang hindi makapag-live together.
Halimbawa, nasa UK ang isang partner habang ang isa ay nasa Pilipinas.
Hindi ibig sabihin nito na hindi genuine ang relationship.
Ang Home Office should look at the relationship as a whole.
Ang importante ay maipaliwanag kung bakit kayo hindi nakatira together at paano ninyo pinapanatili ang inyong relationship despite the distance.
1. Immigration Barriers
Isa ito sa pinakamadalas kong makita sa immigration cases.
Halimbawa:
British citizen o settled na ang partner sa UK pero nasa Pilipinas pa ang applicant dahil wala pa siyang visa para makapasok o manirahan sa UK.
Natural lamang na hindi sila makapag-cohabit permanently.
Hindi maaaring sabihin na dahil hindi kayo nakatira sa isang bahay ay wala kayong genuine relationship.
Pero kailangan ninyong ipakita na despite the immigration barrier, tuloy-tuloy at committed ang relationship ninyo.
2. Work or Studies
May couples na nasa magkaibang lugar dahil sa trabaho o pag-aaral.
Pwedeng ang isang partner ay nasa UK habang ang isa ay nagtatrabaho sa ibang bansa.
Minsan pareho kayong nasa UK pero dahil sa work arrangements, study commitments o accommodation, hindi kayo permanently nakatira sa iisang address.
Again, hindi ito automatic problem.
Pero dapat may credible explanation at supporting evidence.
3. Cultural or Religious Reasons
Particularly sa Filipino context, may mga families at communities na hindi comfortable sa idea ng unmarried couples living together before marriage.
May couples na committed sa isa’t isa pero dahil sa religious beliefs, family expectations o cultural circumstances, hindi sila nag-cohabit.
That can be relevant.
Pero hindi sapat na simply sabihin:
“Bawal po kasi sa culture namin.”
Dapat maipakita kung paano ito genuinely affected your circumstances and why, despite not living together, ang relationship ninyo ay equivalent in substance to a committed marital relationship.
4. Same-Sex Relationships
May mga countries at communities kung saan mahirap o dangerous para sa same-sex couples na openly live together.
Sa ganitong circumstances, maaaring maging relevant ang social, cultural o legal situation sa country concerned.
The Home Office should consider the reality of the couple’s circumstances rather than simply asking why they did not share one address.
Ano ang Evidence Kung Hindi Kayo Nag-Live Together?
Dito kadalasang nagkakaproblema ang applicants.
Hindi sapat na sabihin lamang:
“Three years na po kami.”
Ang Home Office needs evidence.
Depending on the circumstances, maaaring makatulong ang:
- photographs covering different stages of the relationship;
- travel records and flight tickets;
- hotel bookings;
- holidays together;
- regular communication;
- video call or messaging history;
- money transfers;
- financial support;
- gifts and important occasions;
- evidence that your respective families know about the relationship;
- joint plans;
- wedding or engagement plans, if applicable;
- previous periods of cohabitation;
- evidence relating to children;
- joint financial responsibilities;
- evidence of visits to each other; at
- clear explanation kung bakit hindi kayo nakatira together.
Pero tandaan: hindi ito paramihan ng screenshots.
The evidence must tell a coherent story.
Hindi Quantity ang Laban — Quality at Consistency
Isa sa pinakamalaking mistakes sa partner visa applications ay ang pag-submit ng napakaraming documents pero walang malinaw na explanation.
Minsan hundreds of pages ng screenshots ang sinusubmit, pero hindi malinaw:
Kailan nagsimula ang relationship?
Paano kayo nagkakilala?
Kailan naging serious?
Gaano kadalas kayo nagkikita?
Paano ninyo ginagawa ang major decisions as a couple?
Paano ninyo sinu-support ang isa’t isa?
Ano ang future plans ninyo?
Ito ang kailangang makita ng decision-maker.
Ang objective is not simply to prove that you communicate.
Ang objective is to prove that you are genuinely living your lives as committed partners, kahit temporarily separated kayo geographically.
Ang 2-Year Requirement ay Relationship — Hindi Necessarily Cohabitation
Ito ang isang importanteng distinction.
Hindi na tama na sabihin:
“Hindi kayo nagsama for 2 years, therefore hindi kayo qualified.”
The legal question is broader.
Ang tanong ngayon ay whether you have been in a relationship similar to marriage or civil partnership for at least 2 years.
Cohabitation is strong evidence of that relationship.
But absence of cohabitation is not necessarily fatal.
Example
Imagine natin:
Si Maria ay nasa Pilipinas.
Ang partner niyang si James ay British citizen at nakatira sa UK.
Tatlong taon na silang partners.
Hindi sila nakapag-live together continuously dahil si Maria ay walang UK immigration status.
Pero regularly pumupunta si James sa Pilipinas.
May holidays sila together.
Kilalang-kilala sila ng parehong pamilya.
May financial support.
May regular communication.
May future plans sila.
At may clear evidence covering the whole relationship.
Hindi dapat automatic na bumagsak ang application dahil lamang hindi sila nag-share ng same residential address for 2 years.
The application should be assessed on the totality of the evidence.
Pero Mag-ingat Din
Ang pagbabago ng rule ay hindi dapat ma-misinterpret na:
“Okay lang kahit online relationship lang for two years.”
Hindi ganoon kasimple.
The Home Office can still scrutinise whether the relationship is genuinely comparable to marriage or civil partnership.
Kung never pa kayong nagkita physically, halimbawa, maaaring magkaroon ng serious evidential difficulty depending on the circumstances.
Kung minimal ang communication, walang visits, walang financial or emotional interdependence at walang clear evidence ng shared life or commitment, maaaring mahirap patunayan ang required relationship.
My View as an Immigration Solicitor
Sa ganitong applications, hindi ako nagsisimula sa tanong na:
“May 2 years cohabitation ba kayo?”
Ang mas importanteng tanong ko ay:
“Ano ang buong story ng relationship ninyo?”
Because immigration cases are ultimately decided on evidence.
Kung hindi kayo nag-live together, kailangan nating maipaliwanag kung bakit.
Kung long-distance relationship kayo, kailangan nating ipakita kung paano ninyo pinanatili ang relationship.
Kung may cultural, religious, work or immigration reason, kailangan nating document iyon properly.
At kung may weaknesses sa evidence, mas mabuting malaman at ma-address iyon before the application is submitted kaysa hintayin na maging dahilan iyon ng refusal.
Final Point
Hindi na mandatory under the current Immigration Rules na ang unmarried partners ay nakapag-live together continuously for at least 2 years.
Pero ang applicant still carries the burden of proving that the relationship is genuine, subsisting, durable and similar to marriage or civil partnership for the required period.
So ang tamang tanong ay hindi lamang:
“Nagsama ba kayo ng 2 years?”
Ang mas importanteng tanong ay:
“Can you prove that for at least 2 years, you have genuinely lived your relationship as committed life partners?”
