Introduction of new Appendix Victim of Domestic Abuse

The measures now in effect in Part 8, Appendix FM, and Appendix Armed Forces of the Immigration Rules for victims of domestic abuse and their dependent children will be replaced by Appendix Victim of Domestic Abuse.

The following are the main modifications to earlier Immigration Rules provisions:

  • Entry Clearance for Abandoned Overseas Victims: Domestic abuse victims and their dependents may apply for entrance clearance from outside the United Kingdom using the Appendix Victim of Domestic Abuse. This is especially important for people who have experienced domestic abuse and have been abandoned abroad.
  • Fee Waiver for Settlement Applications: Based on destitution, a fee waiver will be granted for both domestic abuse victim settlement applications filed abroad and domestically.
  • Increased Eligibility for Settlement: As a victim of domestic abuse, those who were previously approved as a partner under Appendix FM, Part 11, or Appendix Family Reunion (Protection) of a person with authorization as a refugee are now qualified to apply for settlement.
  • Included Children: Appendix Victim of Domestic Abuse will include provisions for dependent children of victims of domestic abuse.
  • Application of General Grounds for rejection: The Victim of Domestic Abuse route shall be subject to the general grounds for rejection specified in Part 9 of the regulations.
  • On January 31, 2024, these modifications will go into effect.
