Can I apply my family for ILR?

Once your partner has lived in the UK for 5 years straight as your dependent, they can apply for ILR. This could mean that you fill out the application first and your partner fills out theirs later. This is always the case if you can apply for ILR in 2 or 3 years, but your partner must wait 5 years before applying.

Children who depend on you can apply for ILR at the same time you do if:

  • you and the other parent of the child are both applying for ILR at the same time, or you are applying as the child’s only parent.
  • Children don’t have to meet the requirements for continuous residence, but partners do. Also, partners and children over the age of 18 must be able to speak English and pass the Life in the UK test.
